Arbeitsunfähigkeit
In Deutschland ist der Begriff der „Arbeitsunfähigkeit“ in den Richtlinien des Gemeinsamen Bundesausschusses über die Beurteilung der Arbeitsunfähigkeit und die Maßnahmen zur stufenweisen Wiedereingliederung (Arbeitsunfähigkeits-Richtlinien) nach § 92 Abs. 1 Satz 2 Nr. 7 SGB V definiert.
Hier die wichtigsten Regeln:
Arbeitsunfähig gilt ein versicherter Arbeitnehmer, wenn er
- auf Grund von Krankheit seine zuletzt vor der Arbeitsunfähigkeit ausgeübte Tätigkeit nicht mehr oder nur unter der Gefahr der Verschlimmerung der Erkrankung ausführen kann oder
- auf Grund eines bestimmten Krankheitszustandes, der für sich allein noch keine Arbeitsunfähigkeit bedingt, absehbar ist, dass aus der Ausübung der Tätigkeit für die Gesundheit oder die Gesundung abträgliche Folgen erwachsen, die Arbeitsunfähigkeit unmittelbar hervorrufen.
Versicherter Arbeitslose gelten als arbeitsunfähig, wenn sie
- aufgrund von Krankheit nicht mehr in der Lage sind, leichte Arbeiten in einem zeitlichen Umfang zu verrichten, für den sie sich bei der Agentur für Arbeit zur Verfügung gestellt haben, unabhängig davon, welcher Tätigkeit der Versicherte vor der Arbeitslosigkeit nachging.
Zur Beurteilung der Arbeitsunfähigkeit ist eine ärztliche Befragung unerlässlich.
Für die Beurteilung einer Arbeitsunfähigkeit muss ein kausaler Bezug zu einer Krankheit bestehen. Arbeitsunfähigkeit besteht nicht, wenn andere Gründe als eine Krankheit des Versicherten Ursache für eine Arbeitsverhinderung sind.
Die Richtlinien gelten auch für Rentner und für geistig, körperlich und seelisch Behinderte, für Frauen während der Entbindung und noch einige Sonderfälle (s. Link)
